Terms and conditions

These terms are the agreement between Bariki Pharma Group Limited ("Bariki", "we", "us") and the business that registers an account with us ("you"). They apply to every order you place through the website, the Bariki Pharmacy apps, or one of our sales staff.

1. Who may buy from us

We sell wholesale to licensed pharmacies, dispensaries, health centres, hospitals, clinics, NGOs and institutions. We do not sell to the public, and we do not dispense to patients. To open an account you must give us the business details and upload the licence documents we ask for. We verify them before your account can order, and we may refuse or suspend an account if the licence is missing, expired or does not cover what you are ordering.

2. Your account

You sign in with the phone number registered to the business, using a one-time code sent to that number. Keep control of that number and that phone. Orders placed from your account are treated as placed by you, so tell us at once, on +255 744 221 315, if you think someone else has access.

A Bariki sales representative may write an order for you, on your instruction. Those orders appear in your account and are subject to these terms in the same way.

3. Prices and stock

Prices and stock shown in the app and online come from our system and change as stock moves. Your account is on either the wholesale or the retail price list, which we set when we verify your business. Wholesale accounts also see quantity discounts, which apply automatically once the quantity on a line reaches the stated threshold.

The price that applies is the one shown when we confirm your order. We check stock again at that moment, and if an item has run out or the quantity has dropped we will tell you and adjust or cancel that line.

4. Placing an order

An order you submit is an offer to buy. The contract is formed when we confirm the order at our Kariakoo head office. Until then we may decline it, in whole or in part, for example where stock has gone, where the licence on file does not cover the item, or where the order would take you past your credit limit.

You may cancel an order yourself while it is still at "Received". After we confirm it and start picking, contact us and we will help where we still can.

5. Payment and credit

  • You can pay on a credit account, or in cash when the order is delivered. Mobile money (M-Pesa, Mixx by Yas, Airtel Money) will be offered in the app once it is connected; until then it is not accepted.
  • When mobile money is available, those payments will be handled by the provider and we will record only the reference they return to us.
  • Credit accounts, and the limit on them, are granted at our discretion after we verify your business. Invoices on credit are due within 30 days of delivery unless we agree otherwise in writing.
  • An order that would take you past your available credit will not go through on credit. You can still pay for it another way.
  • If an invoice is overdue we may suspend credit, hold further orders, and ask for payment of the balance. We do not charge interest or a late fee on overdue invoices.

6. Delivery

Every online order is picked, packed and dispatched from our Kariakoo head office. Delivery charges, timings and the handover code are set out on the Delivery and returns page, which forms part of these terms. Delivery estimates are estimates, not guarantees.

Risk in the goods passes to you when the order is handed over against your delivery code. Ownership passes when we have been paid in full for that order.

7. Checking, returns and recalls

Check the order against the delivery note before you sign for it. Because these are medicines and medical supplies, what can be returned after handover is limited, and is set out on the Delivery and returns page. Nothing in these terms affects your rights where goods are defective, nor our obligations under a TMDA recall.

8. How you may use the platform

You agree not to:

  • resell or supply what you buy to anyone not entitled to receive it under Tanzanian pharmaceutical law;
  • let anyone outside your business use your account, or share the sign-in number with them;
  • copy, scrape or republish our catalogue, prices or content for a competing service;
  • interfere with the platform, or try to reach accounts or data that are not yours.

9. Our liability

We will supply goods that meet their specification and are fit to be sold by a licensed facility. Beyond that, and to the extent Tanzanian law allows, we are not liable for indirect or consequential loss, including loss of profit or of business, and our total liability for any order is limited to the amount you paid for that order.

Nothing here excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.

You remain responsible for your own professional and regulatory duties: storing what you buy correctly, dispensing it lawfully, and keeping the records your licence requires.

10. Suspending or closing an account

We may suspend or close an account where the licence lapses, where an invoice stays unpaid, where these terms are broken, or where we are required to by a regulator. You may close your account at any time by telling us; see Delete my account. Closing an account does not cancel what you already owe us.

11. Changes to these terms

We may change these terms. The version that applies to an order is the one published when we confirm it. When a change is significant we will tell you in the app or by SMS before it takes effect.

12. Law and disputes

These terms are governed by the laws of the United Republic of Tanzania. We would rather settle a disagreement by talking first, so contact us before anything else. If that fails, the courts of Tanzania have jurisdiction.
